New York Raises Maximum Weekly Lost Wage Benefits for Injured Workers

Lost wage benefits are a critical source of financial support for many injured workers in New York. Starting July 1, 2025, New York will increase the maximum weekly benefit rate for workers’ compensation claimants.
The maximum weekly benefit rate is set at two-thirds of the New York State average weekly wage for the previous calendar year, as determined by the New York State Department of Labor. For 2024, the average weekly wage for New Yorkers was calculated to be $1,833.63. As a result, the maximum weekly benefit for compensable lost time will rise to $1,222.42 for workers injured between July 1, 2025, and June 30, 2026.
Who qualifies for lost wage benefits under New York workers’ comp?
If you’ve been hurt at work or diagnosed with a job-related illness, you may be eligible for lost wage benefits through New York’s workers’ compensation system. To qualify, your condition must keep you out of work for more than seven days. You may also be eligible if your wages are reduced because you’re working fewer hours or doing light-duty work as a result of your injury.
Your individual benefit rate is based on your own average weekly wage from the year prior to your injury, or the statewide average weekly wage – whichever is lower. Importantly, workers already receiving benefits based on an older maximum rate will not see an increase. The new rate will only apply to injuries that occur during the one-year period beginning July 1, 2025.
