When you're hurt in an accident at work, you need a lawyer who knows about hard work. Moving workers' compensation claims forward in the Bronx isn't easy. You need a work accident lawyer who knows the system and knows how to fight for the compensation you need. That's why you need to call Pasternack Tilker Ziegler Walsh Stanton & Romano, LLP.

What are the most common work accidents in the Bronx?

We represent workers in the Bronx and throughout the Five Boroughs who are injured in all the following types of accidents and more:

  • Slip or Trip and Falls
  • Lifting Injuries
  • Machinery Accidents
  • Hit by Objects
  • Work-Related Car Accidents
  • Falls from Heights
  • Exposure to Chemicals
  • Construction Accidents
  • Workplace Violence
  • Electrocution accidents
  • Scaffolding accidents

The workplace accident itself may have been over in a moment, but the consequences can last a long time. Recovering from your injuries may take weeks, months or even years. If you can't work, you can't pay your bills. An experienced attorney can help you get your life back on track.

Can I claim for an accident at work in the Bronx?

Under New York law, if you're injured on the job, you get workers' comp. It doesn't matter whether the accident was your fault, only whether you were working when it happened. Legally, your employer is responsible for the full cost of all reasonable and necessary medical treatment for the accident, as well as partial replacement of lost wages if you can't work. If you have a permanent injury to an extremity, such as a bad knee, due to the accident, you can get compensation for that loss as well.

Can I get workers’ compensation benefits for a fatal work accident?

If you lost a loved one due to a fatal work accident, you may be eligible for workers’ compensation death benefits. This includes funeral expenses and about two-thirds of the deceased’s average weekly wage. To be eligible for workers’ compensation death benefits, you must be the spouse, child, grandchild, parent, grandparent, or sibling of the deceased worker.

Does workers’ compensation pay for pain and suffering?

Workers’ compensation in New York doesn’t provide compensation for pain and suffering. However, a third-party workplace accident claim can pay for pain and suffering linked to your injury, in addition to compensation for medical expenses and lost wages. You would be eligible for this type of claim if someone other than your employer caused your work injury. This can be a third party such as a:

  • Contractor or subcontractor
  • Equipment manufacturer
  • Vehicle driver
  • Property owner
  • Maintenance or utility company
  • Architect or engineer
  • Chemical or materials supplier

Why do I need a lawyer for a work accident in the Bronx?

Actually getting the compensation you need and deserve is rarely easy, though. Your employer may dispute whether you were actually injured at work. They may argue about the extent of your injuries or question whether certain treatments are reasonable and necessary. We'll help you fight back. We know how the system works and how to advocate for the full compensation you deserve, and we'll be with you as long as it takes to get the job done right.
